驳回通知书的意思
在马来西亚，收到驳回通知书，是不是代表我的商标申请被拒绝了？
不一定。驳回通知书会说明，申请继续进行前，商标局需要您更正或解释哪些问题。
回复方式取决于驳回类型：
- 形式驳回涉及申请资料或费用，要求您作出更正。
- 临时驳回涉及商标本身，可能需要提出论据、提供证据或修改申请。
通常不需要马上放弃品牌。Cathca 会审阅通知书，并在期限内准备适当回复。
在马来西亚，我的商标为什么被驳回？
通知书会说明原因。常见理由包括：
- 名称过于常见，或只是描述您销售的商品或服务。
- 与相同或相似商品或服务的在先商标太接近。
- 类别或商品和服务描述需要更改。
即使名称或标志由您自己创作，也须符合这些规定。Cathca 会阅读完整通知书，说明哪些问题可以更正、提出论据，或以证据支持。
在马来西亚，商标被驳回，我在品牌上投入的时间和金钱会白费吗？
驳回需要按时回复，但不代表您在品牌上的投入一定会全部白费。
- 如果驳回涉及商标本身，处理问题期间，申请日仍获保留。解决商标局提出的问题后，申请可继续进行。
- 如果涉及申请形式要求，更正须在通知书指定的期限内完成。如果需要额外时间纠正申请日的问题，申请日可能会改为更正当天。

期限
在马来西亚，商标被驳回后，我有多长时间回复？
通常是从驳回通知书日期起两个月。请查看通知书，确认您的申请期限。
您可在期限届满前请求额外时间：
- 涉及商标本身的驳回，最多可延长六个月。
- 形式驳回，可延长一个月。
Cathca 的延期费用为每月 RM500 起。延期不保证获批，因此我们会以按时回复为目标，只在有需要时讨论延期。
如果我不理会商标驳回通知书，会怎样？
如果没有在期限前回复，根据《2019年商标法令》第 29(6) 条，申请会被视为撤回，不会继续进入注册程序。
错过的期限，只有在有限情况下才可延长，例如出现错误或发生您无法控制的事件。否则，您需要重新申请，并取得新的申请日。
请尽快把通知书发给 Cathca，以便核实期限，并就回复提供建议。
在马来西亚，如果我放弃申请，已缴付的费用能退还吗？
商标局处理申请后，申请费用一般不予退还。商标局本身提供的初步检索服务，则有一项范围有限的退款例外。
在您放弃申请前，Cathca 可审阅驳回理由，说明是否值得继续回复。
您的选择
马来西亚商标被驳回可以上诉吗？
可以。您可在通知书规定的期限内回应驳回。视理由而定，回复可能包括书面论据、修改申请或提供证据。
Cathca 会审阅理由并准备回复。如果商标局仍然驳回申请，您可以要求提供书面理由，并向高等法院上诉。
在马来西亚，商标被驳回后，值得上诉，还是应该换个新品牌重新开始？
这取决于驳回理由，以及您已经为品牌投入了多少。
Cathca 会阅读通知书，坦诚说明各个方案的机会及费用。我们会解释选择，不会向您施压，要求您选择某一条路。
在马来西亚，处理商标驳回期间，我可以继续使用我的品牌吗？
申请待批期间，您可以继续使用品牌；但如果驳回涉及他人的在先权利，应先核实风险。继续使用可能侵犯对方的商标。
等待注册期间，请使用 ™。您还不能使用 ®，也不能依赖注册带来的权利。

在马来西亚，我可以自己回复商标驳回通知吗？
如果您居住在马来西亚，或主要在这里经营业务，可以自行准备回复。回复须符合法律规定，并回应通知书中的每一项驳回理由。
您可能需要证据及相关过往裁决。不完整的回复可能导致最终驳回，届时可能须在短期限内向高等法院上诉，或重新申请。
Cathca 会针对审查员提出的问题准备回复，并在期限前说明所需证据。

第一次沟通，我应该发些什么给你们？
请发给 Cathca：
- 完整的驳回通知书及附件。
- 商标编号或申请编号。
- 此前已提交的任何回复。
如果资料不齐，先把现有文件发来。我们会说明商标局要求什么，以及还需要哪些资料。回应方式取决于通知书中的理由，并非每项驳回都需要上诉。
申请由其他公司提交，Cathca 还能帮忙吗？
可以。即使原申请由其他公司提交，Cathca 也能协助。我们会先审阅驳回通知书、申请资料及此前的回复，这项审阅免费。
之后，我们会就准备上诉回复报价。开始这项工作前，须付清费用。
在马来西亚，回复商标驳回需要另外收费吗？
视乎您的配套，以及原申请由谁提交：
- Peace of Mind 包含上诉回复。
- Best Value 不包含上诉支持。
- 如果原申请由其他公司提交，回复费用通常为 RM1,500 至 RM2,500，视案件复杂程度而定。
如需额外时间回复，延期费用在所有情况下均另计，Peace of Mind 也不例外。Cathca 会免费审阅驳回通知书，并在开始准备回复前报价。
